대한민국과 미군간 주둔지위협정하의 SOFA합동위원회

1.한미주둔군지위협정(SOFA) 제2조 2항은 대한민국과 미합중국 정부는 시설과 구역이나 그 일부가 대한민국에 반환되어야 할지의 여부나 추가 시설과 구역을 제공하여야 할 것인지의 여부에 대하여 합의할수 있다고 규정하고 있다.
2. SOFA 제5조 2항은 대한민국은 SOFA의 유효기간동안 미국에게 부담을 과하지 아니하고 제 2·3·4조의 규정에 따라 모든 시설과 구역, 통행권을 제공할 것임을 규정하고 있다.
3. 위 1·2항에 따라 합동위원회는 1990년 6월 25일 주한미군사령관과 한국 국방장관이 서명한 '서울도심지소재 미군부대의 이전을 위한 기본합의에 관한 대한민국 국방부와 주한미군사령부간의 합의각서'라는 이름의 합의가 SOFA 제2조와 5조 하에 시설과 구역을 제공하기 위해 합법적이고 구속력이 있다는 것을 인정할 필요가 있다. 이 합의는 합의각서(MOA) 제9조의 적절한 용어에 따라 제169차(SOFA)합동위원회 의사록에 기록될 것이다. 더불어 기본 합의각서(MOA)와 이의 양해각서(MOU)는 SOFA 규정에 따라 유효할 것이다.

JOINT COMMITTEE UNDER THE REPUBLIC OF KOREA AND THE UNITED STATES
STATUS OF FORCES AGREEMENT
15 MAY 1991
MEMORANDUM FOR:Chairman, Joint Committe
SUBJECT:Recommendation for Joint Committee Recognition of Agreement
1.SOFA provides in Article Ⅱ, paragraph 2, that the Governments of the Republic of Korea and the United States of America may agree that facilities and areas or portions thereof shall be returned to the Republic of Korea or that additional facilities and areas may be provided.
2. SOFA provides in Article Ⅴ, paragraph 2, that the Republic of Korea will furnish for the duration of the SOFA without cost to the United States all facilities and areas and rights of way as provided in Article Ⅱ,Ⅲ and Ⅳ.
3. Pursuant to paragraphs 1 and 2 above, it is requested that the agreement entitled "Memorandum of Agreement Between The United States Forces in Korea And The Republic of Korea, Ministry of National Defence Concerning Agreements-In-Priciple For Relocation of United States Forces From The Seoul Metropolitan Area" signed by the commander of United States Forces Korea, and the Republic of Korea Minitster of National Defence on 25 June 1990 be hereby recognized by the Joint Committee as a legal and binding agreement to provide facilities and areas under the United States-Republic of Korea Status of Forces Agreement, Articles Ⅱ and Ⅴ. This agreement will be recorded in the minutes of the 169th Joint Committee Meeting in compliance with the applicable terms of Article Ⅸ of subject MOA. In addition, the basic MOA and its MOU will be effective in accordance with the provisions of the SOFA
